Terms and Conditions – Small Group Classes bodyweightfitnessffm (German below) 1. Scope These Terms and Conditions apply to all small group classes offered by Anne Mayer (hereinafter referred to as the “Provider”) under the brand bodyweightfitnessffm. They govern the contractual relationship between the Provider and the participants (hereinafter referred to as “Participants”). Deviations from these terms require written confirmation. 2. Registration and Conclusion of Contract (1) Registration for a class is carried out online via fyndery.com. (2) The contract is concluded upon receipt of the order confirmation. (3) Participants are obliged to provide complete and correct contact details when registering. 3. Trial Classes Trial classes can only be booked via designated trial passes and may be used only once per person. 4. Participation Requirements (1) Participation is at the Participant’s own risk. (2) Participants confirm that they are at least 18 years of age, in good physical health, and have no medical conditions that would prevent them from taking part in the class. (3) In case of uncertainty, it is recommended to seek medical advice before the class begins. 5. House Rules & Conduct in Class (1) The training facilities are accessible only during opening times, which start 20 minutes before the class begins and end 20 minutes after the class finishes. (2) Participants must arrive at least 5 minutes before the start of the class. If arriving after the class has started, entry will not be permitted and participation cannot be guaranteed. (3) The showers in the training facilities may not be used. (4) Instructions from the class instructor must be followed. (5) Participants must bring and wear appropriate sportswear and clean indoor sports shoes during the class, except Yogilates. (6) The use of mobile phones during the class is not permitted. 6. Services (1) The Provider undertakes to deliver the agreed small group classes professionally and competently. (2) Changes to the class schedule, venue, or instructor are reserved, provided these do not substantially alter the overall nature of the offering. 7. Payment Terms & Default (1) Payments are processed via the Fyndery platform. (2) Class fees must be paid in full before the start of the class. (3) Participation without prior payment is not possible. (4) In the event of late payment, the Provider reserves the right to initiate debt collection proceedings. (5) All prices are final in accordance with the small business regulation pursuant to § 19 UStG (no VAT stated). 8. Cancellations, Rebooking & Illness (1) Cancellations are free of charge up to 48 hours before the start of the class. (2) For later cancellations, 50% of the fee will be retained (24 h before) or the full fee if less than 24 hours before the start. (3) Cancellation terms also apply in the event of illness. Exceptions may only be granted at the Provider’s discretion. (4) Rebooking is possible by arrangement, subject to availability. 9. Cancellation by the Provider (1) The Provider reserves the right to cancel or reschedule classes for important reasons (e.g., illness, insufficient number of participants, force majeure). (2) Fees already paid will be fully refunded in such cases or credited towards a future class upon request. 10. Liability (1) Participation is at the Participant’s own risk. (2) The Provider accepts no liability for injuries occurring during the class unless caused by intentional or grossly negligent conduct of the Provider. (3) The Provider accepts no liability for items brought to the class. 11. Photo and Video Recordings (1) Participants are not permitted to take photos or videos in the training facilities. (2) By agreeing to these Terms and Conditions, Participants consent to photos or videos being taken of them by the Provider during classes and used for promotional purposes. 12. Validity of Class Passes The validity period of multi-class passes is stated at the time of booking in the system and begins on the purchase date. Transfer to other persons is only possible by prior arrangement. 13. Data Protection Personal data will be processed exclusively for the performance of the contract and in accordance with applicable data protection regulations. Final Provisions (1) Should any provision of these Terms and Conditions be invalid, the validity of the remaining provisions shall remain unaffected. (2) The law of the Federal Republic of Germany applies. Allgemeine Geschäftsbedingungen (AGB) – Kleingruppenkurse bodyweightfitnessffm 1. Geltungsbereich Diese Allgemeinen Geschäftsbedingungen (AGB) gelten für alle von Anne Mayer (nachfolgend „Anbieterin“) angebotenen Kleingruppenkurse unter der Marke bodyweightfitnessffm. Sie regeln das Vertragsverhältnis zwischen der Anbieterin und den teilnehmenden Personen (nachfolgend „Teilnehmer:innen“). Abweichende Vereinbarungen bedürfen der schriftlichen Bestätigung. 2. Anmeldung und Vertragsschluss (1) Die Anmeldung zu einem Kurs erfolgt online über fyndery.com. (2) Mit Erhalt der Bestellbestätigung kommt der Vertrag zustande. (3) Die Teilnehmer*innen sind verpflichtet, bei der Anmeldung vollständige und korrekte Kontaktdaten anzugeben. 3. Probestunden Probestunden sind ausschließlich über ausgewiesene Probekarten buchbar und können pro Person nur einmal in Anspruch genommen werden. 4. Teilnahmevoraussetzungen (1) Die Teilnahme erfolgt auf eigene Verantwortung. (2) Teilnehmer*innen versichern, mindestens 18 Jahre alt sowie körperlich gesund zu sein und über keine gesundheitlichen Einschränkungen zu verfügen, die einer Kursteilnahme entgegenstehen. (3) Bei Unsicherheiten wird empfohlen, vor Kursbeginn ärztlichen Rat einzuholen. 5. Hausordnung & Verhalten im Kurs (1) Die Kursräume sind ausschließlich während der Öffnungszeiten zugänglich, diese beginnen 20 Minuten vor Kursbeginn und enden 20 Minuten nach Kursende. (2) Teilnehmer*innen erscheinen spätestens 5 Minuten vor Kursbeginn. Bei Erscheinen nach Kursbeginn ist ein Einlass nicht mehr möglich und die Teilnahme kann nicht gewährleistet werden. (3) Die Duschen in den Kursräumen sind nicht zu benutzen. (4) Den Anweisungen der Kursleitung ist Folge zu leisten. (5) Geeignete Sportkleidung und saubere Sportschuhe sind mitzubringen und während des Kurses zu tragen, ausgenommen Yogilates. (6) Die Nutzung von Mobiltelefonen während des Kurses ist nicht gestattet. 6. Leistungen (1) Die Anbieterin verpflichtet sich, die vereinbarten Kleingruppenkurse fachgerecht durchzuführen. (2) Änderungen im Kursplan, Kursort oder der Kursleitung bleiben vorbehalten, sofern diese den Gesamtcharakter des Angebots nicht wesentlich verändern. 7. Zahlungsbedingungen & Verzug (1) Die Abwicklung der Zahlungen erfolgt über die Plattform Fyndery. (2) Die Kursgebühr ist vor Kursbeginn vollständig zu entrichten. (3) Eine Teilnahme ohne vorherige Zahlung ist nicht möglich. (4) Bei verspätetem Zahlungseingang behält sich die Anbieterin vor, ein Inkassoverfahren einzuleiten. (5) Sämtliche Preise verstehen sich als Endpreise im Sinne der Kleinunternehmerregelung gemäß § 19 UStG (keine Ausweisung von Umsatzsteuer). 8. Stornierung, Umbuchung & Krankheitsfall (1) Eine kostenfreie Stornierung ist bis 48 Stunden vor Kursbeginn möglich. (2) Bei späterer Absage werden 50% (24 h) bzw. der volle Kursbetrag einbehalten. (3) Stornierungsbedingungen gelten auch im Krankheitsfall. Abweichungen können nur nach Kulanz der Anbieterin erfolgen. (4) Umbuchungen sind nach Absprache möglich, sofern freie Plätze vorhanden sind. 9. Absage durch die Anbieterin (1) Die Anbieterin behält sich vor, Kurse aus wichtigen Gründen (z. B. Krankheit, zu geringe Teilnehmerzahl, höhere Gewalt) abzusagen oder zu verschieben. (2) Bereits gezahlte Gebühren werden in diesem Fall vollständig erstattet oder auf Wunsch auf einen späteren Kurs angerechnet. 10. Haftung (1) Die Teilnahme erfolgt auf eigene Gefahr. (2) Die Anbieterin übernimmt keine Haftung für Verletzungen, die während des Kurses entstehen, sofern diese nicht auf vorsätzliches oder grob fahrlässiges Verhalten der Anbieterin zurückzuführen sind. (3) Für mitgebrachte Gegenstände übernimmt die Anbieterin keine Haftung. 11. Foto- und Videoaufnahmen (1) Das Anfertigen von Foto- oder Videoaufnahmen durch Teilnehmer*innen in den Kursräumen ist nicht gestattet. (2) Mit Zustimmung zu diesen AGB erklären sich Teilnehmer*innen einverstanden, dass während der Kurse Foto- oder Videoaufnahmen durch die Anbieterin erstellt und zu Werbezwecken genutzt werden dürfen. 12. Gültigkeit von Karten Die Gültigkeitsdauer von Mehrfachkarten ist bei der Buchung im System angegeben und beginnt mit dem Kaufdatum. Eine Übertragung auf andere Personen ist nur nach Absprache möglich. 13. Datenschutz Personenbezogene Daten werden ausschließlich zur Durchführung des Vertrags und gemäß den geltenden Datenschutzbestimmungen verarbeitet. Schlussbestimmungen (1) Sollten einzelne Bestimmungen dieser AGB unwirksam sein, bleibt die Gültigkeit der übrigen Regelungen unberührt. (2) Es gilt das Recht der Bundesrepublik Deutschland.
